It's been 80 years since the Senate has confirmed a Supreme Court nominee who was nominated during an election. And particularly when the court hangs in the balance, it makes no sense whatsoever to give Barack Obama the power to jam through a judge in the final election year.

If you look at the Constitution, the two clauses of the Constitution make it very clear the president shall nominate, and the Senate shall provide advice and consent. It's been since 1888 that a Senate of a different party than the president in the White House confirmed a Supreme Court nominee.

I realize the voters elected President Obama in 2012, but they also, in 2014, elected enough Republican senators to gain a majority in the Senate, so we control the confirmation process. And these are two supposedly coequal branches of government involved in this filling of a Supreme Court vacancy.

While a defeat for Obamacare in the Court would be nice, the defeat of President Obama at the polls on November 6 is crucial. If electoral victory is achieved, Obamacare can and will be repealed - and more judges of a constitutionalist persuasion will be appointed by the next president.

In his first 100 days, Mr. Obama has put the fate of his presidency in the hands of House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid. He may come to regret that decision.

When it comes to judicial nominations, President Barack Obama and Senate Democrats are fond of reminding Republicans that elections have consequences.

The president appoints the judges. Your lives and your children's lives can change by all of these appellate court judges who will be appointed who will reinterpret laws, and things can change.

The president does not have any obligation to make a consensus appointment here. What the president's obligation is, is to pick a judicial conservative, and I believe that's what he's gonna do.

We face a choice this election. President Obama is fighting for changes that grow the economy from the middle out and help all Americans succeed - jobs, education, health reform, the DREAM Act, equal pay for women. He is moving us forward with opportunity today for prosperity tomorrow. Mitt Romney wants to take us back to yesterday.
